Purpose of Notice

Innovus Labs, LLC and its subsidiaries (collectively, “Innovus”) are committed to protecting the privacy, security and confidentiality of personal information belonging to job applicants or those seeking a contract engagement. This privacy notice applies to all applications and all applicants, regardless of medium or location, in North America and South America.

This privacy notice applies specifically to the collection and use of personal information during and after the application process, and is not intended for personnel who are hired as employees or engaged as contractors. This notice may be updated at any time and the most current version can always be accessed at https://www.innovuslabs.com/applicant-privacy-notice.

Please note that this notice may be modified at any time and should be read in conjunction with our privacy policy and cookie policy. In the event of conflicting information, the privacy policy and cookie policy will take precedence with regards to applicants.

This applicant privacy notice does not establish any contractual obligation with Innovus, and cannot be claimed or used as the basis for any such obligation. It does not imply any type of employment, service or other relationship between the reader and Innovus.

Storage of Applicant Data

Personal information maintained by Innovus is capable of identifying an individual through two distinct methods:

  • Individual identification through the establishment of a direct link between the individual and specified details such as their name, social security number, date of birth, place of birth, mother’s maiden name, or biometric records.
  • The creation of a correlation between specified details and information regarding the individual’s medical history, education, financial information and employment history.

In regards to job applicants, Innovus may gather, preserve and utilize the following categories of personal information:

  • Personal contact details, such as names, job titles, home countries, addresses, telephone numbers and personal email addresses
  • Date of birth, social security number, and/or other government-issued identifiers as required for post-offer background checks
  • Professional social media profiles (such as LinkedIn), cover letters, application forms, and other information related to the individual’s employment history, including but not limited to dates of employment, job titles, job descriptions, skills, reasons for leaving, previous salary and benefits information, websites or blogs the individual has contributed to, photographs included in the CV or professional social media profile, areas of interest, and notice periods or availability for employment
  • Salary or other remuneration expectations, as well as details of any offers made by Innovus and the applicant’s responses
  • For US applicants, responses to any Innovus questionnaires related to federal contractor compliance, including but not limited to questions about gender, ethnicity, race, veteran status, and disability status
  • Interview history, questions, notes, technical assessment results, and analysis
  • Information obtained from post-offer background checks, such as references, criminal and credit history, drug testing, fingerprinting check, and other contextual screening results
  • Feedback from applicants regarding the Innovus recruitment process
  • Information collected from website access, such as IP address, browser type, ISP, referring/exit pages, platform type, date/time stamps, number of clicks, domain name, and user location (country)
  • Information required to assess the applicant’s right to work in the hire location, such as work permit status
  • CCTV footage from attendance at any Innovus locations where we control the CCTV systems and any recordings of online video meetings, interviews or assessments
  • Details of communications with Innovus and interaction with email and marketing communications
  • The applicant’s preferences for data privacy and marketing communications

It is important to note that this information is collected for the sole purpose of evaluating the applicant’s suitability for employment or contracting engagements with Innovus. The information may be used to determine the best for open positions, as well as to comply with any legal and regulatory obligations. The information may be shared with third-party service providers who assist with our recruitment and selection processes, but will otherwise be kept confidential and secure.

Your usage of your online profile on Innovus Sites will require us to collect and maintain the following additional categories of personally identifiable information:

  • Your unique login credentials, including username or email, and relevant login data
  • Data related to the frequency and extent of your profile access and usage
  • Information pertaining to the software, hardware, and devices utilized to access your profile
  • Details regarding your profile preferences, as well as any forms that may be completed as part of your online profile.
  • Information regarding your privacy and communication channel preferences.

For California residents - Please note that the categories of information outlined above generally align with the definitions established under the California Consumer Privacy Act, which include:

  • Identifiers
  • Personal information as defined by the California Customer Records Statute
  • Characteristics of protected classifications under California law
  • Biometric information, where consent is obtained and applicable for purposes such as fingerprint background checks
  • Data related to internet or similar network activity
  • Geolocational information in connection with access to Innovus Sites
  • Employment or professional-related information
  • Non-public education information, where consent is obtained and applicable for background check purposes
  • Inferences drawn from other personal information.

Collection of Applicant Data

The personal information of applicants is obtained through the following sources:

  • Direct communication or discussion with you, where you voluntarily provide the information
  • Your interactions with Innovus Sites, including but not limited to our official careers page located at https://www.innovuslabs.com/careers, where you voluntarily provide the information
  • Email applications or recruitment events where you voluntarily provide the information
  • From recruitment agencies, with your consent to release your application information to Innovus
  • From current Innovus employees or contractors as part of our internal referral program, with your prior consent
  • From third-party job boards or websites such as LinkedIn, where you have created a professional profile or sought employment opportunities
  • From third-party websites or platforms that assist in obtaining your contact information or verify your employment history for publicly accessible sources

Use of Applicant Data

The personal information we collect may be utilized for the following purposes:

  • To facilitate the creation, registration and maintenance of your online profile
  • To evaluate your suitability for a role you have applied for, or any other positions that may be available
  • To ensure compliance with federal contractor regulations or other legal requirements
  • To inform you of any changes to our Privacy Policy or Applicant Privacy Notice, security updates, or modifications to Innovus Sites, including but not limited to your online profile area
  • To make informed decisions related to your recruitment or employment, including post-employment actions
  • To determine the terms and conditions of your potential engagement with Innovus
  • To assess any accommodations required in connection with your application
  • To improve our internal recruitment processes and Innovus Sites through internal reporting and analysis of user traffic and applicant pool
  • To ensure the physical security of our personnel, visitors and property

If hired or engaged, your information may be incorporated into our HR or vendor system and used for employment or engagement-related purposes.

Sharing of Applicant Data

At no time will Innovus sell your data that you have provided in connection with the application process.

Innovus may share information regarding your recruitment activity, such as interview feedback or offers if you are being represented by a recruitment agency, for the purpose of facilitating communication with the third party which is representing you.

Innovus’ clients may request a summary of CV’s, including those of applicants and current employees from time to time. Innovus will make best effort attempts to anonymize this information, but it may not always be feasible.

To enhance our internal recruitment processes, Innovus may engage a third-party survey provider to send invitations for surveys and collect responses. Access to the survey responses will be limited to team leaders and recruitment managers within Innovus. The survey results will not impact the progress or outcome of any recruitment process with Innovus, and only your name and email address will be shared with the third-party provider.

Innovus may also partner with a background check vendor to conduct post-offer background checks, with your express consent, which may require sharing personal information such as name, date of birth, address and social security number.

Innovus may also rely upon third party communication providers to manage communications regarding our recruitment and information campaigns. Additionally, third-party service providers may be engaged to manage our applicant tracking system, host our websites or servers, and assist with the administration and analysis of technical assessments. In cases where technical testing is required, third-party providers may be utilized for testing purposes and we may share your name, contact information, primary skills, role or type of role applied for, and resume or CV as necessary. Contractual terms will be established to protect your personal information.

Your data may be shared across all of Innovus for the purposes outlined above. As Innovus operates globally, with a presence in multiple countries, personal information may be transferred to subsidiaries within Innovus, outside of the US borders. It is important to note that, in accordance with this notice, if your personal information is sent or outsourced to a country outside of the one in which you are applying for services, the information may be subject to disclosure by the foreign government or its agencies under a lawful order for purposes not outlined in this notice.

Disclosure of your personal information may be necessary in compliance with legal or regulatory requirements, or if requested by a governmental or regulatory entity. This may also occur if it is deemed necessary to prevent crime, protect against terrorist activities or threats to national security, or ensure the safety or wellbeing of users or staff.

Innovus reserves the right to transfer information, including but not limited to an applicant’s personal information, to a third party in the event of a sale, merger or transfer of assets, or in the unlikely scenario of a bankruptcy, liquidation, or receivership of the business. Innovus will make commercially reasonable efforts to notify applicants of such transfer through means such as email or by posting a notice on the Innovus sites.

Lastly, Innovus may disclose non-personal information, which does not identify a specific individual, aggregated with information about others, to our customers, business partners, merchants, advertisers, investors, potential buyers, and other third parties if we determine, at our sole discretion, that such disclosure serves a sound business purpose or justification.

Security of Applicant Data

Adequate security measures have been implemented to safeguard against accidental loss, unauthorized access, use, alteration or disclosure of your personal information. In the event of a suspected data security breach, established procedures will be activated to address the situation, and any legally required breach notification processes will be followed as necessary.

Your personal information will be retained until it has been reviewed and it is determined that there is no longer a legitimate business purpose for preservation.

Applicant Recruitment

You have the option to receive information regarding Innovus’ recruitment campaigns through email.

You may choose to unsubscribe from these communications at any time through the following methods:

  • Logging into your online profile on Innovus Sites if you have created one, and changing your communication preferences
  • Clicking the unsubscribe link in any recruitment campaign email you have received from Innovus

We will make a reasonable effort to promptly unsubscribe you from these emails, although it may take up to 72 hours to take full effect.

Applicant Consent

By continuing with the application process, you acknowledge and agree to the collection, storage, use, transfer and disclosure of your personal information as described in this notice. Failure to accept these terms will result in denial of access to the online application process as well as consideration of any offline submissions. Your use of Innovus Sites, including but not limited to the Innovus career site or submission of an application signifies your agreement to the transfer of your personal information to countries outside of your country of residence, which may have different data protection laws, as previously outlined. Innovus will implement appropriate technical, organizational and legal measures to ensure the safety and security of your personal information.

Please be advised that the provision of personal information is voluntary, however, failure to provide sufficient information may result in Innovus being unable to evaluate your application.

Additional Terms for United States Based Applicants

In accordance with applicable laws and regulations, applicants may request access to, correction of, or deletion of their personal information, or request restriction of its processing.

Innovus will evaluate any request in accordance with applicable laws and regulations, as well as other legal mandates and rights of Innovus.

In the event of a request for access, correction, deletion, or restriction of personal information, the applicant should clearly indicate what they would like to access to have altered. If they desire suppression of their personal information from Innovus databases or wish to specify limitations, they should inform Innovus accordingly.

Additional Terms for Colombia Based Applicants

If the personal data provided to Innovus includes sensitive information, such as but not limited to photos, identity documents, and fingerprints, Colombian applicants must give express authorization for the use, processing, and transfer of such data for security purposes, information validation, as a biometric identification system, and any other purposes related to those outlined in this notice.
